PRIVACY POLICY

This Privacy Policy ("Policy") governs the collection, use, storage, and disclosure of personal information by Rose Forever Inc. ("Rose Forever," "we," "us," or "our") through the RoseForever.com website ("Site"). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by the terms of this Policy.

Rose Forever is not responsible for the privacy practices of any third-party websites linked to or from the Site.

1. INFORMATION WE COLLECT

Rose Forever collects personal information through several methods:

(a) Registration & Order Processing. To purchase products or access certain features of the Site, you may be required to register and provide personal information including, but not limited to: full name, billing and shipping address(es), email address, phone number, and payment information. This information is used to process transactions, fulfill orders, and communicate with you regarding your purchases.

(b) Email Address. Your email address may be collected when you register an account, place an order, sign up for newsletters or promotional communications, or enter a contest or sweepstakes. By providing your email address, you consent to receiving transactional and, where applicable, marketing communications from Rose Forever. You may opt out of marketing emails at any time via the unsubscribe link included in each communication.

(c) Phone Number & SMS Communications. By entering your phone number at checkout or through any subscription form, you agree to receive text message notifications related to your order (including abandoned cart reminders) and text-based marketing offers from Rose Forever, powered by Postscript. Text marketing messages will not exceed seven (7) per month. Consent to receive text messages is not a condition of purchase. Standard message and data rates may apply. To opt out, reply STOP to any message received. For assistance, reply HELP. Alternative opt-out methods will not be recognized as valid.

(d) Cookies & Tracking Technologies. The Site uses cookies, web beacons, pixels, and server-side tracking technologies to operate the Site, personalize your experience, and deliver and measure advertising. Specifically:

  • Cookies are small text files stored on your device by your browser. Cookies are necessary for core Site functionality including the shopping cart and checkout process. You may disable cookies via your browser settings; however, doing so may impair your ability to use certain features of the Site.
  • Web Beacons & Pixels are used to track page visits, measure the effectiveness of advertising campaigns, and deliver targeted advertisements across third-party platforms.
  • Elevar is used for server-side tracking to collect and transmit accurate event data (such as purchases, page views, and add-to-cart actions) to our advertising and analytics partners. Server-side tracking improves data accuracy and is not subject to browser-level ad blocking.
  • Third-Party Advertising Platforms. Rose Forever runs advertising campaigns through Meta (Facebook & Instagram), Google Ads, and TikTok Ads. Each of these platforms may collect data via their respective pixels and tracking technologies to serve targeted advertisements, measure conversions, and build audience segments. The data practices of these platforms are governed by their respective privacy policies:

(e) Log Files. The Site's servers automatically collect certain technical information upon each visit, including IP address, browser type, Internet service provider, referring URLs, and timestamps. This information is used for system administration, fraud prevention, and internal analytics.

(f) Product Reviews. If you submit a product review, Rose Forever may collect your email address and general geographic location. Your geographic location may be displayed publicly alongside your review; your email address will remain private. Rose Forever is not responsible for any personal information you voluntarily include in a review submission.

(g) Children's Privacy. Rose Forever does not knowingly collect personal information from individuals under the age of thirteen (13). If you are under the age of 13, you are prohibited from submitting personal information to this Site. Users represent that they are at least 18 years of age, or are accessing the Site under the supervision of a parent or legal guardian.

2. HOW WE USE YOUR INFORMATION

Rose Forever uses collected personal information for the following purposes:

  • Processing and fulfilling orders and returns
  • Communicating with you regarding your orders, account, and customer service inquiries
  • Sending promotional emails, SMS messages, and other marketing communications (where consent has been obtained)
  • Personalizing your experience on the Site
  • Improving Site content, layout, and functionality
  • Delivering, optimizing, and measuring the performance of advertising campaigns via Meta, Google Ads, TikTok Ads, and related platforms
  • Transmitting accurate conversion and behavioral event data through Elevar for server-side tracking
  • Detecting and preventing fraudulent transactions and unauthorized access
  • Complying with applicable legal obligations

3. DISCLOSURE OF YOUR INFORMATION

Rose Forever does not sell, rent, or trade your personally identifiable information to unaffiliated third parties for their own marketing purposes. We may, however, share your information in the following circumstances:

(a) Service Providers. We engage trusted third-party service providers to perform functions on our behalf, including order fulfillment, shipping, payment processing, email delivery, SMS communications (Postscript), and analytics and advertising tracking (Elevar, Meta, Google, TikTok). These parties receive only the information necessary to perform their designated functions and are obligated to maintain the confidentiality of such information.

(b) Shipping Partners. To facilitate delivery, Rose Forever shares relevant personal information (including name, shipping address, email, and phone number) with third-party carriers and logistics partners.

(c) Payment Processors. Credit card and payment information is transmitted to third-party financial institutions and payment processors using industry-standard SSL encryption. Rose Forever does not store full payment card information.

(d) Legal Compliance & Protection. Rose Forever may disclose personal information as required by law, regulation, subpoena, or court order, or where disclosure is necessary to protect the rights, property, or safety of Rose Forever, its customers, or others, including for fraud prevention purposes.

(e) Business Transfers. In the event of a merger, acquisition, reorganization, or sale of all or substantially all of Rose Forever's assets, personal information may be transferred to the acquiring entity, subject to the terms of this Policy.

(f) Aggregate & Non-Identifiable Data. Rose Forever may share aggregated, non-personally identifiable information with third-party partners for analytics and advertising purposes.

4. DATA SECURITY

Rose Forever implements physical, administrative, and technical safeguards to protect your personal information, including SSL encryption for all financial transactions conducted through the Site. Access to personal information is restricted to employees and contractors who require such access to perform their job functions. While Rose Forever employs industry-standard security practices, no method of transmission over the Internet or electronic storage is completely secure. Rose Forever cannot guarantee absolute security of your personal information.

5. YOUR CHOICES & OPT-OUT RIGHTS

Upon request, Rose Forever will:

  • Correct or update inaccurate personal information in our records
  • Cease sending marketing emails to your email address
  • Disable your account to prevent future purchases

To opt out of SMS marketing, reply STOP to any text message received from Rose Forever.

To opt out of interest-based advertising, you may adjust your preferences through the platform-level settings of Meta, Google, and TikTok, or use tools such as the Digital Advertising Alliance opt-out at https://optout.aboutads.info.

6. CALIFORNIA PRIVACY RIGHTS — CCPA/CPRA

This section applies exclusively to residents of the State of California and supplements the remainder of this Policy, in accordance with the California Consumer Privacy Act of 2018 as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA/CPRA").

(a) Categories of Personal Information Collected. To the best of our knowledge based on our current technology stack, in the preceding twelve (12) months Rose Forever has collected the following categories of personal information. Actual data collected may vary based on your interactions with the Site and is subject to periodic review as our service providers and tracking configurations are updated.

(b) Purposes for Collection. Personal information is collected for the business purposes described in Section 2 of this Policy, including order fulfillment, customer service, marketing, advertising measurement, fraud prevention, and legal compliance.

(c) Categories of Third Parties with Whom Information Is Shared. Rose Forever shares personal information with the following categories of third parties: shipping and logistics providers, payment processors, advertising platforms (Meta, Google, TikTok), SMS service providers (Postscript), server-side tracking providers (Elevar), and legal or governmental authorities where required by law.

(d) Sale or Sharing of Personal Information. Under the CCPA/CPRA, certain disclosures of personal information to third-party advertising platforms for targeted advertising purposes may constitute a "sale" or "sharing" of personal information, even where no monetary consideration is exchanged. Rose Forever may share personal information, including identifiers and internet activity data, with Meta, Google, and TikTok for cross-context behavioral advertising purposes. California residents have the right to opt out of the sale or sharing of their personal information as described in Section 6(f) below.

(e) Rights of California Residents. Subject to applicable law, California residents have the following rights:

  • Right to Know. You have the right to request disclosure of the categories and specific pieces of personal information Rose Forever has collected about you, the sources from which it was collected, the purposes for collection, and the categories of third parties with whom it has been shared or sold.
  • Right to Delete. You have the right to request deletion of personal information Rose Forever has collected from you, subject to certain exceptions permitted by law.
  • Right to Correct. You have the right to request correction of inaccurate personal information that Rose Forever maintains about you.
  • Right to Opt Out of Sale or Sharing. You have the right to direct Rose Forever to not sell or share your personal information with third parties for cross-context behavioral advertising purposes.
  • Right to Limit Use of Sensitive Personal Information. You have the right to request that Rose Forever limit its use and disclosure of sensitive personal information to purposes necessary to perform the services you have requested.
  • Right to Non-Discrimination. Rose Forever will not discriminate against you for exercising any of your rights under the CCPA/CPRA. We will not deny goods or services, charge different prices, or provide a different level of quality as a result of you exercising your privacy rights.

(f) How to Exercise Your Rights. To submit a verifiable consumer request or to opt out of the sale or sharing of your personal information, please contact us at:

Rose Forever will respond to verified consumer requests within forty-five (45) days of receipt. If additional time is required, we will notify you within the initial 45-day period. Requests may be submitted on your own behalf or through an authorized agent with written proof of authorization.

(g) Data Retention. Rose Forever retains personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law.

(h) Shine the Light. California Civil Code Section 1798.83 permits California residents to request information regarding our disclosure of personal information to third parties for direct marketing purposes. To make such a request, please contact us at help@roseforever.com.

7. OFFLINE COLLECTION

Where personal information is collected offline (e.g., by phone), Rose Forever applies the same standards of care described in this Policy. Information collected offline is entered into our systems using SSL encryption and is subject to the same access and security controls.

8. UPDATES TO THIS POLICY

Rose Forever reserves the right to modify this Policy at any time. Any changes will be posted to this page with an updated effective date. Continued use of the Site following the posting of any changes constitutes acceptance of the revised Policy. We encourage you to review this Policy periodically.
